Overview

Our Elder Law & Special Needs Planning practice group understands the challenges and complexities in addressing the legal needs of aging family members and dependents with special needs or disabilities. We work with our clients to understand what is important to each individual and assist in preparing carefully tailored plans that will safeguard and provide for the people most important in our clients’ lives.

Elder Law

Our Elder Law attorneys thoroughly understand how overwhelming this time can be for individuals and their families, and we strive to ease the burden by combining compassionate counsel with pragmatic planning. We appreciate the sensitivity of thinking about future needs, and help clients plan well in advance, when possible.

Special Needs Planning

Our attorneys have significant experience advising families that include dependents with special needs or disabilities, particularly to plan transitional and ongoing care and financial support for such individuals as they become adults and their parents age. Estate planning for dependents with special needs is deeply personal, and our goal is to provide compassionate counsel with education about special needs trusts and to protect the child’s needs without jeopardizing eligibility for needs-based governmental benefits. Our lawyers frequently meet with community organizations and groups to explain the tax and legal issues associated with special needs planning and asset protection.

How We help

We regularly help seniors, adult or minor children, extended family members, and others:

  • Determine eligibility for government benefits
  • Navigate the complex needs-based benefit system
  • Discuss issues related to guardianship
  • Assist with planning for long term care needs
  • Create supplemental needs trusts
  • Develop end-of-life documents including living wills, health care proxies, general powers of attorney, and Last Wills and Testaments

Our team takes a holistic approach to develop the most effective plan for each family. This means we collaborate with a network of professionals, including healthcare specialists, social workers, and psychologists, to ensure every option has been considered and the legal framework is in place to protect the best quality of life for our clients and their families.
