Overview

Keith D. McDonald is a seasoned attorney specializing in complex commercial litigation, with a strong focus on labor and employment law, including conducting internal investigations, as well as business and shareholder disputes, contract and licensing issues, and unfair competition. He frequently serves as outside general counsel to mid-sized businesses, advising executives, human resources professionals, board members, and other key decision-makers. Keith’s clients span diverse sectors, including food and beverage, consumer products, hospitality, law firms, higher education, transportation, technology, temporary staffing and recruiting, financial services, pharmaceuticals, and more.

In the realm of commercial litigation, Keith has successfully handled many cases involving limited liability company membership disputes, false advertising, trademark infringement, unfair competition, restrictive covenants, and license agreements. He has a substantial federal court practice, including emergent matters, dispositive motion practice, and guiding cases through trial and appeals. Clients appreciate his meticulous attention to detail, client-focused and results-oriented service, thorough preparation, and strategic advocacy skills.

In his labor and employment law practice, Keith represents both employees and management, providing guidance on a wide range of employment-related matters. He has a deep knowledge of state and federal employment laws and remains up-to-date on evolving regulations. Keith advises employers and human resource departments on policies and procedures, with a particular focus on wage and hour compliance, restrictive covenants, and employee leave issues.  Additionally, he reviews and negotiates employment and separation agreements on behalf of corporate executives and other key employees.

A member of the firm’s Investigations practice, Keith has substantial experience in conducting internal investigations of allegations of misconduct or noncompliance in context of employment, higher education, and criminal inquiries. With discretion, he assesses the issues of the investigations, including review of evidence, preparation of subpoenas, and interviews of witnesses, to identify solutions and minimize risk.

  • Secured summary judgment for a prominent manufacturer in a dispute with its foreign licensee, resulting in a monetary judgment exceeding $4 million and declaratory relief.
  • Obtained injunctive relief for investors defrauded in a “Ponzi”-like scheme, leading to a favorable settlement and recovery of attorneys’ fees.
  • Defended a specialty Italian food importer against false advertising claims and successfully achieving summary judgment to dismiss the claims.
  • Secured preliminary injunctive relief for a business client against former employees, protecting the client’s proprietary assets from unfair competition threats.
