Joseph A. Hayden Jr., co-chair of the criminal practice at Pashman Stein Walder Hayden P.C., was recently quoted in a New Jersey Law Journal article titled “Menendez Accused of Acting as Foreign Agent for Egypt in New Indictment.” The article discusses the new set of charges brought against Senator Menendez, accusing him and his wife for conspiring for a public official to act as a foreign agent.

Hayden says the new indictment “will not alter very much the factual dispute about the legality of what Senator Menendez did or did not do.”

Because, as I understood the factual allegations in the original indictment, they are also the underpinning of what we have here. But it does give the defense one additional legal charge or hurdle to jump over in the case, and it gives the jury one additional charge to decide whether or not to convict on,” said Hayden.

It’s one more charge that Menendez has to get by. The problem for Senator Menendez is optics–-optically, does that photograph well?” Hayden said.
