Roger Plawker Quoted in Law360 Article on Town’s Request to Transfer Property Pursuant to Contested Settlement Agreement

Roger Plawker, partner and Chair of the Attorney Ethics & Professional Misconduct practice group at Pashman Stein Walder Hayden, was quoted in the Law360 article, “NJ Town Demands Developers Hand Over Property.” The article discusses Edgewater’s motion in federal court seeking to compel the transfer of a parcel of land pursuant to a settlement agreement between the town and 615 River Road Partners, which settlement agreement is currently being challenged by third-party objectors in state court.

"Edgewater contends, incorrectly, that if the settlement agreement is voided — which it should not be— that it may still enforce select provisions of that agreement," Roger Plawker, counsel for 615, told Law360 Monday.

"615 River Road Partners believes the only sensible approach is to abide a decision in the state court, where both 615 RRP and Edgewater were working cooperatively to defend the settlement agreement against third-party 'objectors' and to preserve the overwhelming benefits to Edgewater including, but not limited to, fulfillment of the largest, single component of Edgewater's affordable housing obligations that is an element of 615 RRP's development project," he said.
