Remi L. Spencer Successfully Argued Before NJ Supreme Court on Behalf of Amicus Curiae ACDL-NJ

Remi L. Spencer, partner in the Criminal Defense and Investigations practices at Pashman Stein Walder Hayden P.C., successfully argued before the New Jersey Supreme Court on behalf of the Association of Criminal Defense Lawyers of New Jersey as amicus curiae, in a case addressing the standard of review for a prosecutor’s decision not to waive a mandatory Graves Act sentence. The Graves Act requires a mandatory minimum for committing a specified offense while using or in possession of a firearm. After 35 years to the contrary, the Supreme Court held that the appropriate standard is “abuse of discretion“as opposed to “patent and gross abuse of discretion”. The case represents an important victory for defendants.
