Pashman Stein Files Amicus Briefs Supporting ATACH and Seth Goldberg and Daniel E. Cohen Attend ATACH’s 2026 Lobby Days in Washington D.C.
In the past few months, Pashman Stein has been fortunate to represent the American Trade Association for Cannabis & Hemp (“ATACH”) in filing amicus briefs in the Fourth and Ninth Circuit Courts of Appeals in appeals challenging a Drug Enforcement Agency rule that classified hexahydrocannabinol (HHC), an intoxicating substance, as a Schedule I drug under the Controlled Substances Act (“CSA”). The actions are Bluestar Operations LLC v. U.S. Drug Enforcement Administration et al., 26-1691, 4th Circuit and IHC Investments, Inc. v. U.S. Drug Enforcement Administration et al., 26-3739, 9th Circuit. The Plaintiffs in these actions manufacture products containing HHC and contend that their products are legal and exempt from the HHC because, they claim, they are derived from hemp, which was made federally legal under the 2018 Farm Bill. As set forth in the attached amicus briefs, on behalf of ATACH, Pashman Stein argued that HHC does not fall within the Farm Bill’s definition of hemp because HHC is made by converting tetrahydrocannabinol molecules using various chemical processes. Both appeals are fully briefed and awaiting decision.

DC Lobby Days is ATACH’s signature advocacy event, bringing together cannabis and hemp industry stakeholders, leaders, and supporters to engage directly with federal policymakers. The event provides a structured opportunity to have one-on-one or small group meetings with congressional offices, attend receptions, and amplify industry priorities on Capitol Hill.
