The Honorable Edwin H. Stern, P.J.A.D (Ret.), special counsel at Pashman Stein Walder Hayden P.C., authored an article published in the Seton Hall Law Journal of Legislation & Public Policy, titled “Habeas Corpus” (49 Seton Hall J. Legis. Pub. Pol’y (2025)).  The paper was originally part of an oral presentation given at the Seton Hall Law Journal of Legislation & Public Policy Symposium held in April 2024, which was then converted into an article titled, “An Innocent-Centered View of New Jersey’s Post-Conviction Jurisprudence.”

In the paper, Judge Stern discusses the legitimacy and constitutionality of New Jersey's post-conviction relief (PCR) and habeas corpus rules, particularly the amendments adopted in 2009. He concludes by suggesting that, in light of evolving legal thought and a recent paper authored by Professors D. Michael Risinger & Lesley C. Risinger, as well as the papers of others who participated in the Symposium, further ongoing review of these rules may be warranted to ensure continued alignment with justice and New Jersey constitutional principles.
