David N. Cinotti, partner at Pashman Stein Walder Hayden P.C., recently authored an article in Law360 titled, “Justices' Ruling Will Ease Foreign Arbitral Award Enforcement.” Cinotti’s article discusses how the U.S. Supreme Court’s recent decision in Fuld v. Palestine Liberation Organization makes it easier for U.S. courts to enforce foreign arbitral awards under the New York Convention. The Court’s ruling that the Fifth Amendment does not require the traditional “minimum contacts” test for personal jurisdiction means that award creditors may now pursue enforcement against foreign parties in U.S. courts even when those parties have little or no connection to the United States.
