Yet the court may decline to rule on the matter in the wake of a recent update to CUMMA, which happened after the high court decided to review Wild’s case, that added workplace protections for medical marijuana use outside the workplace, according to attorney Sean Mack, a partner in Pashman Stein Walder Hayden PC’s Hackensack, New Jersey, office.

That won’t mark the end, though, of medical marijuana cases for labor attorneys, Mack said. Future lawsuits are likely to be focused on what types of reasonable accommodations employers must make and what kinds of jobs are too safety-sensitive to permit an accommodation for medical marijuana use, Mack said.

"As the number of people using medical marijuana in New Jersey increases, I would expect to see more lawsuits as more people undoubtedly will test positive for marijuana. It will then be left to the courts to define the contours of what is acceptable and what is not," Mack said.
