Pashman Stein Walder Hayden P.C.’s Bankruptcy Team Represents Chapter 11 Trustee for Epic! Creations

Gambale, attorneys in Pashman Stein’s Bankruptcy, Restructuring & Creditors’ Rights Practice, were recently mentioned in a Law360 article titled, “Judge Locks Down Byju Entity's IP In Ch. 11.” The article discusses a recent decision by a Delaware bankruptcy judge to void transfers of an Apple App Store account linked to the insolvent U.S.-based financing arm of Indian education technology giant Byju's, as the Chapter 11 Trustee rang the alarm about "bad actors" trying to make off with the Debtors’ cash and intellectual property.
On November 12, 2024, U.S. Bankruptcy Judge John T. Dorsey granted an emergency motion from the Chapter 11 Trustee for Epic! Creations to void attempts to transfer the ownership of Debtors’ Epic and Osmo accounts on the App Store to Voizzit Technology Pvt. Ltd. and change the names of the Debtors’ accounts on app and payment platforms — actions which put in jeopardy over $1 million of monthly revenue, the Chapter 11 Trustee's counsel said.
After Chapter 11 Trustee Claudia Z. Springer discovered that rogue officers used their position as administrator of the Debtors’ Apple developer accounts to surreptitiously direct Apple, to transfer registered ownership of the Debtors’ Epic and Osmo applications to Voizzit Technology Private Ltd., she decided that immediate action was required to combat and reverse these rogue actions.
