Pashman Stein Partner David Cinotti Featured in Law360 for Amicus Brief in Third Circuit Arbitration Case

David N. Cinotti, parter in the Litigation practice at Pashman Stein Walder Hayden, P.C. was featured in the Law360 Article, “Profs, Pashman Stein Partner Back Buford in 3rd Circ. Case.”

Cinotti, who has two decades of experience with domestic and international arbitration, has been granted leave to file an amicus curiae brief in the U.S. Court of Appeals for the Third Circuit in In re: Application of Financialright Claims GmbH, which raises novel issues of interpretation under the Federal Arbitration Act. In his amicus brief approved for filing on December 17, 2025, Cinotti urged the Third Circuit to reconsider its decision that the FAA did not apply to an arbitration agreement asserted in a proceeding for discovery in aid of foreign litigation under 28 U.S.C. § 1782.

Also filing an amicus brief requesting the Third Circuit revisit its ruling were two prominent international arbitration professors, represented by Troutman Pepper Locke LLP.
