A case in which Pashman Stein Walder Hayden P.C. managing partner Michael S. Stein, partner David N. Cinotti, and counsel Darcy Baboulis-Gyscek represent Allstate before the New Jersey Supreme Court was featured in the Law360 article, “Docs Ask NJ Justices To Send Allstate RICO Case To Arbitration” and the New Jersey Law Journal article, “Sending Fraud-related PIP Claims to Arbitration Will Have 'Massive' Effects on Insurance Industry, Allstate Tells NJ Justices.”

Cinotti argued before the New Jersey Supreme Court on January 22, 2026, defending the New Jersey Appellate Division’s decision that auto insurers are not required to bring claims for fraud under the Insurance Fraud Prevention Act, the state RICO statute, and common law to the mandatory alternative dispute-resolution system (called “PIP arbitration”) established under the state’s no-fault auto insurance laws.
