Dawn Attwood Quoted in Law 360 Discussing Immunity for Public Entities in New Jersey

Dawn Attwood, partner at Pashman Stein Walder Hayden, was quoted in the Law 360 article “NJ Justices Toss Turnpike Crash Suit After Theory Change.” The article discusses a recent New Jersey Supreme Court ruling in a case in which Dawn Attwood and Jason D. Attwood represented the New Jersey Turnpike Authority.  The Court overturned the Appellate Division ruling and reinstated summary judgment for the Turnpike Authority, finding that plaintiffs did not establish an issue of material fact regarding whether there was a dangerous condition, as they changed their theory of liability and had previously made admissions that negated the new theory of liability.

Dawn Attwood of Pashman Stein Walder Hayden PC, representing the authority, told Law360 in a statement on Wednesday, "This decision is an important victory for public entities and their contractors as the intent and purpose of the Tort Claims Act are reinforced, as are general negligence principles with respect to a party's burden of proof."
