David Cinotti Quoted on Supreme Court's Overturning Long-Standing Takings Clause Precedent

David Cinotti attorney at Pashman Stein Walder Hayden quoted in the Law360 article, “Knick Ruling Levels The Field, May Signal Court's Agenda.” The article explains that the U.S. Supreme Court made a decision to overturn a 1985 ruling, and landowners will now be able to take their claims directly to the federal court.

"It may open up other questions about when a taking occurs," said David Cinotti of Pashman Stein Walder Hayden PC, who was not involved in the Knick case. "There may be more issues now decided in federal court. ... There could be more clarity on the takings clause."

"Land use is a quintessential state issue. It has been thought of that way for a long time. State judges are much closer to the ... day-to-day issues dealing with land use," Cinotti added. “That's a big concern for the dissenters."
