CJ Griffin, Partner at Pashman Stein Walder Hayden, was quoted in a NorthJersey.com article discussing a lawsuit filed against Morristown regarding the township clerk’s failure to provide settlement agreement documents requested pursuant to the Open Public Records Act.

Griffin represents resident Kelly Montes, who requested the documents that involve numerous lawsuits that have been filed against the town and officials.  While the clerk produced some agreements, the clerk refused to produce settlement agreements negotiated by the town’s insurance carrier.

Filed by attorney CJ Griffin, the lawsuit claims Morristown "had an obligation to obtain the requested settlement agreements” from its insurance carrier in order to comply with Montes’ request. A similar lawsuit was filed in Gloucester County after the Gloucester County Board of Freeholders denied an OPRA request for settlement agreements because they “were in the hands of the County's insurance broker."

"The settlement agreements at issue here were ‘made’ by or on behalf of the Board in the course of its official business and thus the Board was required to produce them," read the appellate court decision in Burnett v. County of Gloucester.
