Bruce Rosen, Partner at Pashman Stein Walder Hayden P.C., was recently quoted in a New Jersey Monitor article titled “Legislators Pass Bill That Would Restrict Lawsuits Meant to Silence Critics”. The article reports that New Jersey lawmakers unanimously passed legislation Friday June 30, 2023 intended to shut down lawsuits that aim to intimidate or silence detractors.

“The person who’s being sued is basically being terrorized, whether it’s a small-town journalist or someone speaking at a council meeting trying to stop a project. Unless you’re getting free legal help, you’re going to immediately send up the white flag and do what they want. This bill is meant to stop these intimidation tactics by people with money and power. It’s a really good day for free speech in New Jersey, and it’ll be better when Gov. Murphy hopefully signs it,” said Bruce Rosen.

Without laws like this in place, journalists, activists, and others targeted by baseless lawsuits can spend upwards of thousands of dollars to fight them in court. Many of those targeted do not have insurance to protect against defamation and such claims.

“I’ve represented bloggers that get sued — their life is totally upended. They’re thinking of bankruptcy and ‘how am I going to afford this?’” Rosen said.
