Bruce Rosen Obtains Dismissal of Defamation Complaint Regarding Text Chain

Bruce S. Rosen, a partner in Pashman Stein Walder Hayden P.C., recently won a motion to dismiss a defamation lawsuit where the Plaintiff alleged that defamation took place on a text chain with only family members – even though the complaint clearly stated that none of the others on the text chain believed what the defendant was saying! The decision in Cohen v. Lyandvert by Hon. Anthony Suarez, J.S.C. in Superior Court, Bergen County was with prejudice, meaning the plaintiff could not sue again based on the same facts.

Bruce is part of PSWH’s defamation/media law team and a frequent litigator of defamation claims, including anti-SLAPP (Strategic Lawsuits Against Public Participation) claims where faulty claims filed to inhibit speech are subject to special mechanisms for a quick resolution. Because this complaint involved a private matter, the anti-SLAPP law could not be used.
