Denise Alvarez Quoted in New Jersey Monitor Article Regarding NJ Supreme Court Decision Reaffirming Right to Privacy in Secret Recordings of Phone Calls at Police Stations

Denise Alvarez, counsel at Pashman Stein Walder Hayden P.C., was quoted in New Jersey Monitor article, “Police can’t secretly record phone calls, N.J.’s top court rules in win for privacy advocates.” The article discusses a recent unanimous New Jersey Supreme Court decision which upheld the trial court’s suppression of a telephone call received by the defendant from her boyfriend, who called her using a telephone at the police station after he was arrested. Neither the caller nor the defendant was notified that the call would be monitored or recorded. Denise Alvarez filed an amicus brief in the case on behalf of the Association of Criminal Defense Lawyers of New Jersey.

“This is a privacy win,” Alvarez said. “As Justice Albin put it, today’s decision reaffirms our constitutional ‘right to be free from government officials arbitrarily prying into our personal conversations.’ A person does not lose that right to privacy simply because they are arrested and in a police station — or called by someone from a police station.”
