In an Opinion delivered on May 29, 2019 by U.S Chief District Judge Freda L. Wolfson, the Court granted Pashman Stein Walder Hayden attorney Andrew Bayer's motion for summary judgment, and dismissed a lawsuit against the Monmouth County Prosecutor’s Office saying that an African American detective provided no evidence to show that he was passed over for promotions because of his race. Andrew represented the Monmouth County Prosecutor’s Office and Christopher Gramiccioni, who was the acting prosecutor and supervisor of the detective.
Hon. Wolfson noted in her opinion that the detective, Daniel Baldwin, failed to “substantiate his claims with objective evidence, i.e., promotional memoranda, resumes, or related documents.” She also wrote, “Time and time again, Plaintiff's arguments are without factual basis, as he either relies on nothing more than his own subjective beliefs and opinions, or he inappropriately challenges Defendants' authority to exercise discretion in employment decisions.”
