Sean Mack, co-chair of the Litigation practice at Pashman Stein Walder Hayden P.C., was featured on NBC News 4 I-Team segment on February 21, 2024, with Sarah Wallace regarding the ongoing bankruptcy case of companies controlled by Cesar and Jennifer Pina. A company controlled by the Pinas filed for bankruptcy last fall, after Mack filed a lawsuit in state court on behalf of real estate investors in connection with an alleged Ponzi-scheme. On behalf of investors, Mack then filed an involuntary petition against another Pina controlled company. In October 2023, Cesar Pina was arrested and charged with wire fraud.

Judge Gambardella of the United States Bankruptcy Court for the District of New Jersey issued an order for the arrest of the Pinas if they don’t fully comply with her order to provide requested information by Friday, February 22, 2024.

In the interview Mack explained:

“The subpoena asks for basic information-copies of tax returns, copies of assets, lists of creditors, bank accounts, the most basic financial information about the company and to my understanding, they Penas have turned over almost nothing so the Trustee is really left still guessing as to what all the assets are.“

“The goal is not to put them in jail for this process.  The goal is to force them to finally start cooperating and telling the trustee where the money is.”
