Hon. Edwin H. Stern, P.J.A.D (Ret.), Special Counsel at Pashman Stein Walder Hayden P.C., participated on a panel concerning the law of search and seizure at the annual Criminal Justice Institute at the New Jersey Bar Center. Judge Stern emphasized the need to argue state constitutional and legal grounds in support of motions to suppress physical evidence because of the greater protections under state law than the Fourth Amendment to the United States Constitution. He also pointed out some greater protections that are now recognized and noted some practice requirements relating to preservation of appeals following guilty pleas. The panel took place on Saturday, December 2, 2023.
