Partners Justin Walder and James W. Boyan III were mentioned in Law360 article, “Hospital Groups Want To Join Fight Over Drug Discount Rule” in connection with their representation of American Hospital Association, 340B Health, America's Essential Hospitals, the Association of American Medical Colleges, the Children's Hospital Association, and the American Society of Health-System Pharmacists. Justin and Jim, together with co-counsel, filed a motion to intervene on behalf of the hospital trade groups in two separate lawsuits brought by Sanofi-Aventis and Novo Nordisk in the United States District Court for the District of New Jersey challenging the U.S. Department of Health and Human Services' view that drugmakers must give discounts to pharmacies serving low-income areas.

The hospital trade groups allege that the drugmakers want to block their members' lawful access to the so-called 340B program, which requires drugmakers participating in Medicaid and Medicare to sell outpatient drugs at a discount to nonprofits, community health centers and other publicly funded facilities that cater to the underserved.
